This Privacy Statement applies to The Elements Coaching BV., hereinafter referred to as The Elements, located at Wilhelminalaan 10, 3851 XW Ermelo. Where this statement refers to “we,” “us,” or “our,” it refers to The Elements. We are registered with the Chamber of Commerce under number 08067932.

This Privacy Statement applies to the use of our websites https://theelements.health and Zelfherstel Online, the app for participation in our program, as well as for the purchase of other services, including training and coaching. In addition to this Privacy Statement, the General Terms and Conditions and our Disclaimer also apply. By visiting our website(s) and participating in our program and/or other services, you automatically agree to this Privacy Statement, the Terms and Conditions, and our Disclaimer.

If you participate in The Elements, your personal data will be stored, such as name, address, place of residence, and other information that you provide. This personal data is used by The Elements to maintain contact, conduct market research, and inform by e-mail about all services of The Elements. The personal data you provide will not be made available to third parties unless there is a legal obligation or a court order.

By visiting this website, filling in forms, or contacting us, you share your personal data with us. We explain below how we handle your data. We do this as carefully as possible and comply with the applicable laws and regulations. This privacy statement applies to all forms of communication and interaction between you and The Elements.

Data We Process

If you participate in our program, we process the following data about you:

  • Email
  • First name
  • Surname
  • Name of company or organization
  • Bank account/IBAN number
  • Payment and invoice details
 

As a participant, you can add the following information yourself:

  • Address
  • Residence
  • Telephone number
  • Profile picture
  • Other information you enter into your account
 

Note: You are obliged to keep the information you have provided factually correct and complete.

Purposes of Use

To provide you with the best possible service, it is necessary for The Elements to store your personal data in certain cases. The legal basis for processing your personal data is based on Article 6, paragraph 1, under b GDPR: “processing is necessary for the performance of a contract.” We therefore use your personal data for:

  • Providing access to our website
  • Using the functionalities of the website and our network
  • The execution of transactions and the provision of our services
  • Relationship management, such as when customer service is contacted
  • Sending newsletters and updates (messages are sent from MailBlue; data shared with MailBlue is managed by agreements to ensure careful handling)
  • Gaining insight into the use of our website and network
  • Product and service development
  • If necessary, to trace unlawful conduct with regard to The Elements, its trainers, coaches, and employees

Retention periods vary:

  • Emails are stored for at least one year. Older emails are deleted after two years unless they are relevant for an agreement or dispute resolution.
  • Invoices and quotations are deleted after the legal retention period of seven years.

You have the right to:

  • View, correct, and delete your personal data
  • Withdraw consent for data processing or object to data processing
  • Request data transfer
 

Requests can be sent to our e-mail address. We must verify the authenticity of the request. We aim to respond within 48 hours. You can also submit complaints to the Dutch Data Protection Authority.
